- Civil Unions and Domestic Partnerships: In some jurisdictions, civil unions or domestic partnerships provide similar rights to marriage for non-traditional couples, including same-sex couples.
Marriage and Civil Unions:
- Divorce: Family law governs the dissolution of marriage through divorce. This includes the grounds for divorce (e.g., irretrievable breakdown, adultery), procedures for filing, and the division of marital assets and debts.
- Legal Separation: This allows couples to live apart without dissolving the marriage. Legal separation may involve court orders related to spousal support, child custody, and division of assets.
- Annulment: An annulment declares a marriage null and void, as if it never existed, usually due to reasons like fraud, coercion, or incapacity.
Divorce and Separation:
- Custody: Family law determines who has the right to make decisions about the child’s upbringing (legal custody) and where the child will live (physical custody). Custody can be joint (shared by both parents) or sole (awarded to one parent).
- Visitation: Non-custodial parents are usually granted visitation rights to spend time with their children. The court may create a schedule, taking the child's best interests into account.
- Best Interests of the Child: Courts prioritize the child’s well-being when making custody and visitation decisions, considering factors such as the child’s age, relationship with each parent, and the parents' ability to provide care.
